A new trial date has been set for Cardell Hayes, the man accused of killing former New Orleans Saints star Will Smith.
Court documents show it has been moved to January 2024 instead of February 2024. This all comes after it appeared Hayes would plead guilty to manslaughter and attempted manslaughter to avoid a new trial.
Earlier this week, sources said Hayes had agreed to plead guilty to manslaughter and attempted manslaughter for killing the former Saints star and hurting his wife in a 2016 shooting.
He was expected to plead guilty Wednesday, but things fell apart in court.
Hayes was originally charged in April 2016 with murder and attempted murder for killing Smith, a former team captain and Saints legend, and shooting his wife, Racquel.
A jury voted 10-2 to convict him of manslaughter and attempted manslaughter instead for the late-night gunfire. Then, in 2020, Hayes was among about 100 Louisiana prisoners impacted by a U.S. Supreme Court ruling that outlawed non-unanimous jury verdicts for those convicted by them who had not yet exhausted their appeals.
Because the split jury had convicted Hayes on the lesser counts, he couldn't be retried again for murder, the Louisiana Supreme Court decided. Hayes has remained free since March 2021, while his new trial was delayed repeatedly.
